Terms of use

This is the end user licence agreement for Tito Digital Evidence. It is an agreement between you and Larissa Barbosa, the developer of the app, and Apple is not a party to it. Using the app means accepting it. If you do not accept it, do not use the app.
What the app is
Tito Digital Evidence browses inside itself, captures what a site displayed, records the network context of each navigation, computes two digests of every file, builds a tree from them, signs the session's record with a key held inside the device, asks a public RFC 3161 authority to certify the instant before the first navigation and the instant the session closed, and issues a certificate describing all of that. It imports nothing from outside itself, and it does not edit, crop, filter, correct or recompress what it captured, nor alter the rendering of the page.
What the app does not promise
The app produces evidence of integrity, of time and of the circumstances of a capture. It does not perform electronic authentication of the captured content and does not attest to its truthfulness. It does not and cannot guarantee that any court, authority, arbitrator or third party will accept a session, nor what weight they will give it. Whether the displayed content corresponds to the reality it purports to show — staging, editing, fabrication, a forged page, a false profile, synthetic content — is beyond what any capture can establish. Deciding whether a capture may lawfully be made, and what may lawfully be done with it afterwards, is yours.
Licence
You are granted a non-transferable licence to use the app on any Apple-branded product that you own or control, as permitted by the Usage Rules of the Apple Media Services Terms and Conditions. You may not sell, rent, redistribute, sublicense, decompile, reverse-engineer or modify the app, except to the extent the law allows it in spite of this restriction.
Your sessions
The captures, the recordings, the page sources, the network context, the metadata, the digests and the certificates are yours and stay on your device. We have no access to them, no copy of them and no way to recover them. Deleting a session is permanent, and the deletion is recorded in the app's audit panel with its instant and the identifier of what was removed. Keeping backups is yours to do.
How you use it
You are responsible for what you navigate to and capture, for the terms of the sites you visit, and for any personal data of third parties that ends up inside a session or inside a folder you hand over. The app conducts no scan of a site: what is recorded is the browsing a person conducted, with that person's choices.
The subscription
Browsing, capturing, recording, computing digests, timestamping, issuing the certificate and reading everything inside the app are free and unlimited. The subscription removes one limit and no other: taking the session folder out of the app. Without it you may export one session, once — not one a month. It is counted per session, so exporting that same session again — including handing it over once more after a provisional certificate was replaced by the definitive one — costs nothing, and a share sheet you cancel spends nothing.
It is an auto-renewable subscription offered for one month or for one year, at the price shown in the App Store in your currency at the moment of purchase. Payment is charged to your Apple Account on confirmation of purchase. The subscription renews automatically for the same period unless it is cancelled at least 24 hours before the current period ends, and the account is charged for the renewal within the 24 hours before that period ends. You manage it and cancel it in the settings of your Apple Account; the app cannot do it for you. Where a free trial is offered, any unused part of it is forfeited when a subscription is bought. Purchases and refunds are handled by Apple, not by us.
Maintenance and support
We alone are responsible for maintaining and supporting the app. Apple has no obligation whatsoever to furnish any maintenance or support for it. Write to support@titoprivacyai.com.
Warranty
We alone are responsible for any warranty covering the app, express or implied by law, to the extent it is not effectively disclaimed. If the app fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price of the app to you. To the maximum extent permitted by applicable law, Apple has no other warranty obligation whatsoever with respect to the app, and any other claims, losses, liabilities, damages, costs or expenses attributable to a failure to conform to any warranty are our sole responsibility.
Claims
We, not Apple, are responsible for addressing any claim of yours or of a third party relating to the app or to your possession and use of it, including product liability claims, any claim that the app fails to conform to a legal or regulatory requirement, and claims arising under consumer protection, privacy or similar legislation. If a third party claims that the app infringes their intellectual property, we, not Apple, are solely responsible for the investigation, defence, settlement and discharge of that claim.
Legal compliance
You represent that you are not located in a country subject to a United States Government embargo, or designated by that Government as a terrorist-supporting country, and that you are not listed on any United States Government list of prohibited or restricted parties. You agree to comply with any third-party terms that apply to your use of the app.
Apple as third-party beneficiary
Apple and its subsidiaries are third-party beneficiaries of these terms and, upon your acceptance of them, have the right — and are deemed to have accepted that right — to enforce these terms against you.
Limits of our liability
To the extent the law permits, we are not liable for indirect or consequential loss arising from use of the app, including the loss of sessions, a deadline missed, or a session refused by a third party. Nothing written here limits rights that the law does not allow to be limited.
Changes
These terms change as the app changes. The date at the top says when this version was published, and the version in force always answers at this address.
Governing law
These terms are governed by the law of the Federative Republic of Brazil. The rights you hold as a consumer under the Código de Defesa do Consumidor, or under the mandatory law of the country where you live, are untouched by anything written here.
